What the EAA asks of a website

The European Accessibility Act (Directive 2019/882) requires that certain products and services are accessible to people with disabilities. For websites, the services in scope include e-commerce, banking, transport ticketing, e-books and electronic communications. It has applied since 28 June 2025, transposed into each member state's own law.

The Act itself does not name a technical standard. The harmonised standard EN 301 549 does that job, and for web content it points at WCAG 2.1 Level AA. So in practice, testing your site against WCAG 2.1 AA is testing it against the EAA.

Microenterprises providing services, generally under 10 staff and under 2 million euro turnover, are exempt for services. The exemption is narrower than people assume and does not cover products, so check your own position rather than assuming.

How enforcement actually starts

It is worth being plain about this, because the market for accessibility software runs on fear and the fear is usually mis-specified. There is no inspector browsing shops looking for contrast failures. In practice enforcement begins with a complaint, from a consumer or a consumer organisation, to the market surveillance authority in that member state. The authority then asks you what you have done.

What that means practically: the risk is not being audited at random, it is having nothing to show on the day somebody asks. A dated report and evidence that you acted on it is a materially different position from a shrug, and it costs very little to be in the first position rather than the second.

What to do first

Test your site against WCAG 2.1 AA and fix what comes back, starting with anything on the path to a purchase. Cart and checkout matter more than the about page, because that is where an inaccessible control stops being an annoyance and starts being a lost customer.

Does the EAA apply to my online shop?

If you sell to consumers in the EU and you are not a microenterprise providing services, most likely yes. E-commerce is explicitly in scope. The microenterprise exemption is narrower than most people assume, so check your own position against your national transposition rather than assuming it covers you.

What standard does the EAA require?

The Act does not name one. The harmonised standard EN 301 549 does, and for web content it references WCAG 2.1 Level AA. Testing against WCAG 2.1 AA is the practical way to test against the EAA.

What are the penalties?

Penalties are set nationally and vary widely across member states. More useful than the headline numbers is how the process starts: with a complaint to a market surveillance authority, which then asks what you have done about it. Having a dated report and a remediation record is the difference that matters.

Is an automated audit sufficient for the EAA?
